The judge orders the Trump administration to maintain the “guard and control” of any migrant expelled in South South

A federal judge wonders if the Trump administration expelled migrants to South Sudan Tuesday in violation of a previous order prohibiting the deportations of migrants to countries other than their own without giving them enough chances to challenge their withdrawal.
An ordinance of the American district judge Brian Murphy Tuesday evening orders the government to “maintain custody and control” of any person expelled to South Sudan covered by legal action contesting the practice of the administration to deport migrants to third countries “to ensure the practical feasibility of the return if the court concludes that such moves were illegal”.
The judge’s ordinance comes after the lawyers for the National Immigration Alliance Alliance and other groups have filed an emergency request to prevent the government from deporting migrants to South Sudan, saying that they had indications that at least 12 migrants had been sent to the Eastern African country.

The lawyers said they thought that one of the men, from Myanmar identified in court documents like “NM”, had been withdrawn from the Port Isabel detention center in Texas in South Sudan on Tuesday morning. Lawyers also allege that a Vietnamese migrant called TTP “seems to have suffered the same fate”.
The two men appointed to the file have dismissal orders in their country of origin, lawyers said.
During a virtual hearing organized Tuesday at the Boston American district court, a lawyer for the Ministry of Justice told the judge that NM had been expelled in Myanmar, not in South Sudan. But the lawyer refused to say where TTP had been sent, saying that the information had been classified, according to a report from the hearing in the New York Times.
The lawyer also said that the current location of the plane carrying migrants to delete as well as its final destination had been classified, according to Times.
Murphy, a named Biden, told MJ’s lawyer that officials who had made deportations in violation of his previous order could face a criminal outrage procedure, according to Times. Lawyer Trina Realmuto, of the National Immigration Alliance Alliance, who was present for the hearing, confirmed this account.
ABC News contacted DHS to comment on the alleged references to South Sudan.

As part of his order, Murphy also asked the government to be ready to identify the affected deportees and provide more details on their withdrawal and the opportunities of each person to raise a fear based on fear.
The US State Department Currently advises American travelers do not visit South Sudan due to the threat of crime, kidnapping and armed conflicts.
Another hearing in the case is scheduled for Wednesday at 11 a.m.
Last month, Murphy made an order forcing the Trump administration to provide individuals with written notice before being transferred to a third country and a “significant opportunity” to raise concerns about their security. The preliminary injunction also prohibits the government from withdrawing a migrant to a third country without screening for possible risks for its security in this country and a 15 -day window to contest the determination of the government according to this screening.
In a statement, one of NM’s lawyers said that he was also one of the men that the Trump administration tried to deport Libya earlier this month, triggering a legal race to block it. In this case, the judge declared that the withdrawal of men in Libya without regular procedure “would clearly violate” his order.
